The Auto Accident Lawyers

If you have been involved in a car or motorcycle accident, it is important to take steps to protect your legal rights before it is too late. Even accidents that occur at low-speed, or don’t result in much damage to your vehicle, can cause long-lasting physical injuries. Cape Fear Law PLLC can help you recover the expenses of repairs, medical costs, and loss of pay from being unable to work.

Helping you secure the maximum compensation you are entitled to.

Protect Your Rights

North Carolina is one of the few states that uphold contributory negligence. This means if you are found to have contributed to the accident in any way, you can be denied the rights to a claim. Cape Fear Law PLLC will investigate your accident to ensure all facts are accurate and properly represented.

While your own insurance company will cover expenses resulting from an accident caused by an uninsured or underinsured driver, they will try to minimize their losses by offering a low settlement amount. Cape Fear Law PLLC can negotiate with your insurance company for a settlement that benefits you.

Recovering damages from an accident involving commercial vehicles, such as tractor-trailers, can be daunting. Such accidents often involve representatives from many parties, including the trucking company, the driver, and even the company of the products being transported – all interested in minimizing payments to you. Cape Fear Law PLLC can help you through this complicated process and secure the maximum compensation you are entitled.

On Your Side

If a settlement offer isn’t in your favor, our attorneys will file and pursue lawsuits. No one wants to go to court, but unfortunately, there are times when protecting your future requires judgment. Cape Fear Law PLLC will recommend if court action is necessary and will be there for you every step of the way.

Our experienced legal team will help you apply for assistance that helps make ends meet after a work-related injury that prevents you from fulfilling some or all of your duties on the job.

You deserve compensation for your medical bills and lost wages. We can help you find your way.

A FEW OF OUR MANY SUCCESS STORIES

Deborah B. (Estate of Kristopher B.)

Kristopher B. was 26 years old when he was killed in a collision with an 18-wheeler in Greensboro, NC. His fiance was a passenger in the car and asleep at the time. The driver of the 18-wheeler stated that Kristopher caused the accident. Without eye witnesses to confirm who was at fault, Cape Fear Law PLLC was able to negotiate a settlement of $980,000.00 for Kristopher’s estate administered by his mother, Deborah. Along with the fiance’s settlement, Cape Fear Law PLLC was able to reach the policy limits of the 18-wheeler’s insurance at pre-litigation mediation.

Awarded

$980,000

Emeterio C.

Emeterio was injured in a crash with an off-duty police officer. Following the accident, he was released from his first doctor’s care with no restrictions and no surgical recommendations, yet Emeterio’s pain persisted. Consulting Cape Fear Law PLLC, we guided Emeterio to a specialist, who immediately recognized his continuing symptoms and, after an MRI, found Emeterio had suffered a shoulder tear requiring surgery. Cape Fear Law PLLC was able to secure $150,000.00 for Emeterio, compensating him for his injury and medical costs.

Awarded

$150,000

Kennard R.

Kennard was involved in a head-on collision when a drunk driver crossed the center line. The drunk driver then collided into several other vehicles, causing terrible injuries to all. Kennard suffered massive injuries as a result of the wreck and had to undergo several surgeries at UNC Chapel Hill. He was left in a persistent vegetative state that required round the-clock care. Even though the drunk driver had limited insurance coverage, and there were multiple claims presented, including a claim for wrongful death, Cape Fear Law PLLC was able to secure $145,000.00 of the available coverage to offset Kennard’s medical expenses.

FREQUENTLY ASKED QUESTIONS

WHAT IS A PERSONAL INJURY CLAIM?

A personal injury claim is an insurance claim presented to the at-fault driver’s insurer for damages. These damages can include: medical expenses, lost wages, the cost of future medical care, pain and suffering, and future loss of earning potential.

DO I NEED AN ATTORNEY?

Yes. The adjuster may say “you don’t need an attorney, we can handle this on our own,” but they are being less than honest with you. The insurance company will send you forms that are impossible to understand, have you make recorded statements where they ask the same questions several ways to hurt your credibility; and ultimately offer you less money than your claim is worth. An adjusters’ only goal is to settle your claim for as little as possible for their employer. Do not trust them.

HOW MUCH DOES AN ATTORNEY COST?

Our office only gets paid when you get paid. We work on a contingency fee basis and you are never under any pressure or obligation to settle your claim unless you are comfortable with the dollar amount.

WHAT IS CONTRIBUTORY NEGLIGENCE?

Contributory negligence is a law in NC that states that if you are even one percent at fault for the accident, you are unable to recover damages from it.

SHOULD I USE MY HEALTH INSURANCE TO PAY FOR MY MEDICAL BILLS?

Generally, yes. Although we are able to help clients who don’t have health insurance necessary to seek medical treatment, using your health insurance will allow you to see a much larger field of providers and specialists.

WHAT IS MEDICAL PAYMENTS COVERAGE?

Medical Payments Coverage is a coverage that you may have on your auto or home insurance policy. It helps you cover the costs of your medical bills and is available regardless of who was at fault in an accident. We never take a fee from medical payments coverage because it is not fault-based.

WHAT SHOULD I DO ABOUT MY PROPERTY DAMAGE CLAIM?

Insurance companies handle property damage claims separately from claims of bodily injury. You can usually get a good idea of the value of your vehicle from www.nada.com, using your vehicle’s mileage and condition. Our office generally does not handle property damage claims as we would have to charge clients a flat fee for such services. However, when insurance companies are seriously undervaluing your vehicle’s worth or giving our clients a hard time with rental car coverage, we are sometimes able to assist getting these claims resolved.
